To assist CAASA’s training committee to compile CAASA’s training schedule for next year, CAASA invites you to share your experiences in construction adjudication practice in the Southern African construction industry with CAASA.
Please let CAASA know, in your experience of adjudication in the Southern African construction industry:
What are the criticisms you have of how the ad hoc or contractual construction adjudication model is typically being applied in the Southern African construction industry?
Whether adjudication on construction projects occurs mainly during construction of the works or only when the construction works are either almost complete or in fact completed?
Is adjudication in the Southern African construction industry delivering on its intended purpose – a quick and relatively inexpensive resolution of a dispute? If not, then what are the impediments?
Are you finding that adjudicator’s determinations are mainly accepted by the parties? Or are most disputes, even after an adjudicator’s determination is made, still being referred to either arbitration or court proceedings?
Is the unsuccessful party mainly making payment according to the terms of the adjudicator’s determination promptly after the adjudicator’s determination is made? Or are successful party’s having to apply to court to enforce the adjudicator’s determination?
Are there any specific topics relating to construction adjudication which you would like CAASA to present a webinar on?
